Hayward man turns himself in after fatal hit-and-run

FREMONT – A Hayward driver who authorities say was drunk turned himself in to Fremont police last week in reference to the suspected fatal hit-and-run crash involving an unidentified jogger, a news release said.

Police said the suspect, a 29-year-old Hayward man, was allegedly under the influence of medicine and alcohol Sunday night when he struck a pedestrian jogging northbound near Mission Boulevard and Nursery Avenue. Authorities found the jogger dead on the scene around 8:40 p.m., police said.

According to police, suspect Brian Gutierrez allegedly fled the scene on foot before police contacted him by phone. Police said he later decided to show himself in to authorities.

“Alcohol and drug influence as well as speed may have played a role in this collision,” police said.

According to jail records, police arrested Gutierrez in Hayward at 9:59 p.m. He was booked into the Santa Rita Jail Monday morning on charges of hit-and-run and driving under the influence with bodily injury.

His arraignment is scheduled for 9 a.m. Wednesday morning in Section 702. He is being held on $125,000 bail.

According to police, that is the fifth traffic fatality in Fremont this yr.
